What we do not collect

We do not ask for and do not want your health information. Clear Nervous System Noise offers educational and wellness content, not medical care. Please do not send us medical history, diagnoses, symptoms, or treatment details.

We do not knowingly collect information from anyone under 16. If you believe a child has given us information, email info@clearnervoussystemnoise.com and we will delete it.

We do not collect or process sensitive personal information as CCPA defines it (government ID numbers, financial account credentials, precise geolocation, racial or ethnic origin, religious beliefs, union membership, genetic or biometric data, or the contents of your mail, email, and messages).

3. Why we use it, and our legal basis

Under GDPR we must name a lawful basis for every use. Here they are:

  • Consent.

  • Contract.

  • Legitimate interest.

  • Legitimate interest.

  • Legal obligation.

  • Legitimate interest.

Where we rely on consent, you can withdraw it at any time. Withdrawing does not affect anything we did before you withdrew.

Where we rely on legitimate interest, you can object. Email info@clearnervoussystemnoise.com and we will stop unless we have a compelling reason not to.

4. Who we share it with

We do not sell your personal information to anyone. We do not share it for cross-context behavioral advertising. We have not sold or shared personal information in the preceding 12 months. The one sharing we do is with summit presenters, described at the end of this section.

We do use service providers who process information on our behalf, under contract, and only on our instructions:

  • MailerLite, in the European Union.

  • Zoom, in the United States.

  • Google Analytics (Google LLC), in the United States.

Squarespace is our domain registrar and DNS host. It holds the registration for clearnervoussystemnoise.com and does not process your personal information.

We may also disclose information where the law requires it, to enforce our terms, or in connection with a sale or merger of the business. If ownership ever changes, we will tell you before your information is transferred.

Summit presenters.

5. International transfers

We are based in Salt Lake City, Utah, in the United States.

Your email subscriber record and the site itself are hosted by MailerLite in data centers located in Germany and the Netherlands, inside the European Union. Because we access that data from the United States, some transfer out of the EEA does occur. MailerLite participates in the EU-US Data Privacy Framework, the Swiss-US Data Privacy Framework, and the UK Extension to the EU-US Data Privacy Framework, and we have a Data Processing Addendum in place with them.

Google Analytics and Zoom process data in the United States. Both are certified under the EU-US Data Privacy Framework and its UK Extension, and we rely on Standard Contractual Clauses where the Framework does not cover a transfer.

Where any other transfer of personal information out of the EEA or UK takes place, we rely on Standard Contractual Clauses or on the receiving provider’s Data Privacy Framework certification. You can request a copy of the safeguards in place by emailing info@clearnervoussystemnoise.com.

6. How long we keep it

  • Your email subscriber record:

  • Our suppression list of unsubscribed addresses:

  • Consent records, meaning timestamp, source, and opt-in language:

  • Registration and attendance records:

  • Summit session recordings:

  • Contact form messages:

  • Website analytics:

  • Payment records:

7. Your rights

If you are in the EU or UK (GDPR), you have the right to:

  • Access: get a copy of the personal information we hold about you

  • Rectification: have inaccurate information corrected

  • Erasure: have your information deleted (the right to be forgotten)

  • Restriction: have us pause processing while a dispute is resolved

  • Portability: receive your information in a portable, machine-readable format

  • Object: object to processing based on legitimate interest, including profiling

  • Withdraw consent: at any time, without penalty

  • Complain: lodge a complaint with your national supervisory authority. In the UK that is the Information Commissioner’s Office at ico.org.uk.

If you are a California resident (CCPA/CPRA), you have the right to:

  • Know: what categories of personal information we collect, the sources, the purposes, and who we disclose it to

  • Access: request the specific pieces of personal information we hold about you

  • Delete: request deletion, subject to legal exceptions

  • Correct: request correction of inaccurate personal information

  • Opt out of sale or sharing: we do not sell or share, so there is nothing to opt out of, but the right exists

  • Limit use of sensitive personal information: we do not collect it, so there is nothing to limit

  • Non-discrimination: we will never charge you more, give you less, or deny you service for exercising a privacy right

How to make a request.

We will verify your identity by matching the information in your request against what we hold, usually by confirming you control the email address on file. We do not charge for requests. We respond within 30 days for GDPR and within 45 days for CCPA, and we will tell you if we need an extension.

8. How we protect it

We use encryption in transit (HTTPS), limit access to the small number of people who need it, require multi-factor authentication on our email and hosting accounts, and work only with providers who maintain their own security programs. No system is perfectly secure, and we cannot guarantee absolute security. If a breach puts your rights at risk, we will notify you and the relevant authority within 72 hours of becoming aware of it, as GDPR requires.

9. Cookies and email tracking

Cookies, pixels, local storage, and the tracking in our emails are covered in our Cookie Notice at www.clearnervoussystemnoise.com/cookies.

10. Terms and conditions

Your use of this site, our emails, and the summit is also governed by our Terms and Conditions at www.clearnervoussystemnoise.com/terms.

11. Changes

We review this policy at least once every 12 months. If we make a material change we will update the date at the top and, where the change is significant, email subscribers before it takes effect.
